Applicability

Every visit to and use of this website (www.handelshuurloket.be; hereinafter the “Website”) is subject to these Terms of use and to the Privacy policy and Cookie policy.

Acceptance and amendment

By visiting and using the Website, you are deemed to have read and accepted these Terms of use. The Website may only be used in accordance with these terms.

The content of these Terms of use may be adapted, amended or supplemented at any time without prior notice. The Terms of use were last amended on 1 August 2024.

Copyright

The Website and its content (including texts, photographs, logos, hyperlinks, etc.) are protected by copyright and other intellectual property rights belonging to Handelshuurloket and/or third parties. Users are prohibited from infringing these rights.

Intellectual property and restrictions on use of the Handelshuurmonitor

Ownership and copyright. The Handelshuurmonitor, including the calculation tool, the underlying source code, the calculation logic, the texts, the design and its compilation, is a work protected by copyright within the meaning of Book XI of the Belgian Code of Economic Law. All intellectual property rights are vested in Handelshuurloket.
Permitted use. You may consult and use the Handelshuurmonitor free of charge for your own non-commercial information purposes in connection with a specific commercial lease situation. Any other use requires the prior written consent of Handelshuurloket.
Prohibition of reproduction and re-exploitation. Without the prior written consent of Handelshuurloket, it is not permitted to take the tool or any substantial part of it and:
- copy, reproduce, download, store or duplicate it, in whole or in part, in a manner exceeding normal browser use,
- publish, distribute, make it public, integrate it (including via framing, inline linking or embedding) or make it available on another website, application or platform,
- modify, translate, adapt, reverse-engineer or decompile it, or create derivative works from it,
- commercially exploit, sell, rent out or license it, in whole or in part,
- extract or collect data from it by automated means (scraping, crawling or similar techniques).
Notices and security. It is not permitted to remove, circumvent, obscure or alter copyright notices, trade marks, the source attribution, the watermark or any other aspect of the tool.
Enforcement. In the event of infringement, Handelshuurloket reserves all rights, including an action for cessation and for compensation for the damage suffered.

The Handelshuurmonitor provides an automated calculation based on the data you enter and the Belgian Commercial Lease Act of 30 April 1951. Competent courts and applicable law

Disputes arising from the use of the Website shall be submitted to the courts and tribunals of the jurisdiction of the Ghent Court of Appeal, and specifically to the judicial district of West Flanders, Bruges division. Belgian law applies.
