This is the privacy policy (hereinafter the “Privacy policy”) of Handelshuurloket (and every lawyer affiliated with Handelshuurloket).

Through this Privacy policy we wish to inform you as fully as possible about the way in which we collect and process your personal data. Our Privacy policy applies to all relationships between us on the one hand and our clients, suppliers, partners, prospects, opposing parties, etc. on the other.

We attach great importance to your privacy and do everything we can to protect it. We act in accordance with the Regulation of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter also the “Regulation”), and with this Privacy policy.

Our professional rules of conduct as lawyers also include numerous obligations relating to the protection of personal data.

Which personal data do we process, and why?

As a law firm we collect and process various categories of personal data, including identification and contact details, financial data, family data, data concerning your criminal and judicial history, data about your professional career, etc. These data may relate to you as a client or supplier of our firm, or as a business relationship of one of our clients.

We collect and process both data that you provide to us directly and data that we obtain through other channels, such as public sources. Our website also uses cookies; more information can be found here. We do not use automated decision-making or profiling.

Your personal data are processed for various purposes, including our general and financial administration, the management of our client and supplier records, the provision of proper services, and the performance of our agreements, including direct marketing activities.

On which legal grounds do we process your personal data?

Article 6.1 of the Regulation sets out the legal grounds on which personal data may be processed. We process personal data on the basis of:

  1. Your consent: we process personal data with your express and specific consent. This consent is freely given and may be withdrawn at any time.
  2. Legal and professional obligations: as a law firm we must comply with various legal obligations that require us to keep specific personal data. This applies, among other things, to obligations under anti-money laundering law, tax law and social legislation.
  3. Performance of a contract: processing personal data is necessary for the proper performance of our agreements with clients and suppliers. We limit ourselves to the data strictly required.
  4. Legitimate interest: we also process personal data to defend our interests and those of our clients, or for other legitimate interests that we or our clients, suppliers, etc. may have in processing these data.

Who has access to your personal data?

Only a limited number of persons, such as our employees and staff, have access to your personal data. To protect your privacy, they are bound by confidentiality agreements.

We also work with third-party service providers who process your personal data to a limited extent for specific purposes, such as a bailiff. We ensure that these service providers process your data only in accordance with our instructions and that they offer sufficient guarantees for the confidentiality and security of your data.

If a service provider is established outside the European Economic Area, we ensure that your personal data are transferred only where an adequate level of protection is guaranteed.

Your personal data are not disclosed to third parties for commercial or promotional purposes, unless you have given your express consent.

How long do we keep your personal data?

We retain your personal data for as long as necessary to comply with our legal and professional obligations, to provide our services properly, or because we have a legitimate interest in retaining the data for longer.

What rights do you have regarding your personal data?

The Regulation gives you various rights regarding the processing of your data. At any time, you can:

  1. Request access to your data: you have the right to consult, free of charge, the data we hold about you and to know what they are used for.
  2. Have data rectified: you can ask us to correct inaccurate data and to complete incomplete data.
  3. Have data erased: if you suspect that we are processing certain data unlawfully, you can request their deletion. This request may be refused if the data are necessary for a legal obligation, the performance of a contract, or our legitimate interest.
  4. Have data transferred: you have the right to request that the data you have provided to us be transferred to you or to a third party.

In addition, under certain circumstances and conditions as set out in the Regulation, you have the right to:

  1. Restrict the processing of your data.
  2. Object to the processing of your data based on our legitimate interest. No objection is possible against the processing of data that are necessary for legal obligations, the performance of contracts, or our legitimate interest.

Where processing is based on your consent, you may withdraw it at any time.
